Draft. This page hasn't been reviewed by a lawyer yet, and it will change before Strawberry Safe leaves early access. If anything here matters to you, ask us at support@strawberrysafe.com.
These terms are the agreement between Strawberry Safe LLC (“we”), which runs the Strawberry Safe service, and the organization that uses it (“you”). By creating an account or joining an organization in Strawberry Safe, you agree to them yourself — and if you set up an organization, you agree to them for the company you set it up for.
If you don't agree, don't use the service.
Strawberry Safe keeps a register of your safety equipment, the inspections your people record against it, and the reports built from those records, such as the audit pack. It reminds you when inspections fall due, and lets you share a read-only view with people you choose.
Strawberry Safe records the judgement of the people who inspect your equipment. It doesn't inspect anything itself. It never vouches that a piece of equipment is safe or fit for use, and never states that your organization meets OSHA, ANSI, a manufacturer's instructions, or any other standard or rule.
The built-in checklists are starting points, marked as drafts until they have been reviewed. Your organization decides what its inspections ask, who it treats as a competent person, and when gear goes back into service or is retired.
An audit pack reproduces your records as they were made: what was recorded, by whom and when. It says nothing about the equipment beyond that, and we can't promise that an auditor, client or regulator will accept it.
Each person needs their own account. Signing a record in Strawberry Safe is signing it as yourself, so don't sign in as someone else and don't let anyone use your account. If you think someone has, tell us straight away at support@strawberrysafe.com.
Your organization owns its records: the register, the inspections, the photos and signatures, and the files you upload. We use them only to run the service for you, as the privacy policy describes.
You can export your register and your audit packs whenever you like. If you stop using Strawberry Safe, we'll help you take a full copy with you.
Don't use the service to record things you know to be false, to break the law, to reach another organization's records, or to disrupt the service for anyone else — including by probing it for weaknesses without our permission. Upload only files and photos you have the right to share.
Strawberry Safe is in early access. Features change, some things are unfinished, and there is no charge unless we agree otherwise in writing. Before paid plans start, we'll tell you the price and you can choose whether to continue.
If your organization has a separate written agreement with us, that agreement wins wherever it and these terms differ.
We work to keep the service running and your records safe, including regular backups. But it's provided as it is: we don't promise it will always be available, free of errors, or suited to a particular purpose. Keep a way to record an inspection if the app or a phone is unavailable.
As far as the law allows, we aren't liable for indirect or consequential losses, or for decisions made about equipment on the strength of the records in the app. Our total liability to you for anything to do with the service is limited to what you paid us in the twelve months before the claim, or $100 if you paid nothing.
You can stop using Strawberry Safe at any time. We can suspend or close an account that breaks these terms, telling you why wherever we reasonably can. Either way, you get the chance to export your records first.
We'll change these terms as the service grows. When we do, we'll update the date at the top, and for a change that matters we'll email your organization's admins before it takes effect. Using the service after that means you accept the new terms.
